3. Merchant Representations & Accuracy of Information

By submitting a MCA Contract Review Request Form, the Merchant represents, warrants, and affirms that:

 

  • All information provided is true, accurate, complete, and current

  • All contracts, agreements, bank statements, remittance records, and supporting documents are authentic and unaltered

  • The Merchant has full authority to submit the materials for review

 

McDONNELL HOPKINS relies entirely on Merchant-provided information. Any inaccuracies, omissions, or misrepresentations may invalidate findings and relieve McDONNELL HOPKINS of any liability.

4. Authorization for Forensic AI Contract Analysis

​

The Merchant hereby grants full, express, and irrevocable authorization for McDONNELL HOPKINS to perform a comprehensive forensic review, including but not limited to:

 

  • Forensic MCA contract audit

  • Remittance and cash-flow financial analysis

  • Usury, predatory term, and structural scrutiny

  • AI-driven business cash-flow review

  • Merchant protection and risk mitigation strategy

  • Fully customized action route based on findings

This authorization permits the use of advanced forensic methods, financial modeling, and artificial intelligence-assisted analysis for internal evaluation and reporting purposes.

​

5. Electronic Signatures & Legal Validity

 

The Merchant agrees that:

 

  • Any electronic signature, checkbox, typed name, or digital consent constitutes a legally binding electronic signature

  • Such consent is valid and enforceable under the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and applicable state laws

  • Electronic authorization remains valid until expressly revoked in writing and acknowledged by McDONNELL HOPKINS

6. No Guarantee of Outcome

​

All findings are analytical and advisory in nature. McDONNELL HOPKINS does not guarantee outcomes, litigation success, settlement results, or financial recovery.

7. Limitation of Liability

To the fullest extent permitted by law, McDONNELL HOPKINS shall not be liable for any indirect, incidental, consequential, or punitive damages arising from use of the Website or services.

8. Governing Law & Jurisdiction
